上海應用技術學院基本建設合同管理辦法細則（暫行）

normal style=line-height: 150%; text-indent: 32pt; margin: 0cm 0cm 0pt; mso-char-indent-count: 2.0>上海應用技術學院基本建設合同管理辦法，必須以《中華人民共和國民法通則》、《中華人民共和國合同法》、《中華人民共和國建筑法》等有關法律法規(guī)為依據(jù)。結合《上海應用技術學院合同管理暫行辦法》和基本建設工程實際，制定本細則。

合同”是指上海應用技術學院法人授權委托人在學?；窘ㄔO工程中為明確雙方的民事權利、義務關系所訂立的書面協(xié)議，包括：工程勘察、工程設計、工程施工、工程監(jiān)理、材料設備采購、技術咨詢、服務（不含投資監(jiān)理、財務監(jiān)理）等與基本建設工程相關的合同、協(xié)議、備忘錄、確認書等。

normal style=line-height: 150%; text-indent: 32pt; margin: 0cm 0cm 0pt; mso-char-indent-count: 2.0>三、依據(jù)基本建設資金來源的性質合同分類為：含有市財政經費的基本建設合同、學校自籌資金的基本建設合同，按照統(tǒng)一的流程進行審批管理。

基建處起草管理、部門審核監(jiān)督、主管校長審批簽署”的制度；合同的審批程序：由基建處負責起草，經審計處、監(jiān)察處、財務處審核，報分管校長審批、簽署后，由基建處加蓋合同專用章并保管。具體職責：

normal style=line-height: 150%; text-indent: 24pt; margin: 0cm 0cm 0pt; mso-char-indent-count: 1.5>（四）合同內容經審核需要修改的，由基建處負責修改，必要時可以組織合同乙方、學校相關部門進行商務談判，有重大變更的需經學校同意后方可進行合同修改，并按照以上程序重新流轉、審核、會簽。

上海應用技術學院基本建設工程合同審核流轉表（以下簡稱：流轉表）”的形式會簽，相應的附件按照招投標的形式不同分別為：
